Terms of Use

TENANT RIGHTS: You Do Not Have Tenant Rights. You agree by booking this property that you do not have any tenant rights in the state in which the property reside. As such, you mare " Guests" of the owner and can and will be asked to leave the property at any time without prior notice for any of the reasons listed in the rental agreements and terms and conditions. You agree to not order any services in your name to the home including phone, cable services, utilities, or any other service that might provide a bill with your name and the address of the property in which you are a guest. You agree that you are a guest no matter how many days you have been a guest at the property. 

MAINTENANCE: It is expected that major systems in and around the condo will break down from time to time such as air conditioning, washer, dryer, refrigerator, etc. The Property Manager will attempt to repair the problem as soon as possible upon notice by the Guest. The Property Managers and Owners assume no liability to Guests if such should occur as all products have a useful life and break down occasionally.

ILLEGAL DRUGS: Under no circumstances shall any illegal drugs be allowed on the property. Guests understand that possession and use of any such substance are grounds for immediate eviction and forfeiture of payment. Guests further waive any and all rights to recourse against The Property Managers and Owners for enforcing this clause.

GUESTS RESPONSIBILITIES: All occupants are required to perform "Normal" household duties that include, but are not limited to: • Garbage removal • Cleaning of individual and guest dishes • Notification to Property Manager of any damages or problems with the property • Locking of all doors when guests leave the condo unit.

SUBLETTING/ASSIGNING/OCCUPANCY: There shall be no subletting of the premises. The Guests shall occupy and use the premises as a vacation rental only and not use the premises for any business, professional, unlawful or hazardous purpose.

REPAIRS: The Guests must be notified immediately if you discover any item that needs attention.

At the end of the term, the Guest shall leave the premises clean and in good condition, remove all guest property, and repair all unreasonable damages caused during their stay.

HOLD HARMLESS AND INDEMNITY: The Property Managers and Owners of rental property shall not be liable for any damages and/or injury to Guest and/or their guest(s), or their personal property due to Guest's acts, actions, or neglect. Guests agree to hold The Property Managers and Owners harmless against any claim for damage and/or injury due to a Guest's act or neglect or their guest's act or neglect.

QUIET ENJOYMENT: Guests and their guests agree not to violate the quiet enjoyment and privacy of the surrounding neighbors. The Property Managers and Owners are not responsible for the actions of other property owners in the area, as we have no control over their actions.

WEATHER / ACTS OF GOD: The Property Managers and Owners are not responsible for any weather conditions or acts of God or nature that happen during the Guest's stay on-premises and refunds will be made on a case by case basis.

CONSTRUCTION: The Property Managers and Owners are not responsible for any actions of other property owners or condo associations.

UNFORESEEN CONDITIONS: If any unforeseen conditions or problems with the Vacation Rental arise prior to or during the Guest's stay that makes the vacation rental uninhabitable, The Property Managers and Owners reserve the right to either refund Guest's payment pro-rate or place the Guest's in a comparable house with the same amenities, bedroom, etc. Such unforeseen conditions could be the following but are not limited to, hurricanes, storms, vandalism, flood, fire, etc. The Property Managers and Owners assume no responsibility for such unforeseen conditions.

ACCESS: Guests agrees to allow access to the house and property to The Property Managers, Owners, and Agents of the Property manager at any time as they are not tenant and hold no tenant rights. Agents include but are not limited to, plumbers, electricians, rental companies, pest inspection, etc. The Property Managers and Owners reserve the right to inspect the premises and condo interior at any time without prior notice to the Guests. Guests agree not to deny access. If the Guest refuses to allow access to The Property Managers, Owners, or their Agents, the Property Managers and Owners reserve the right to terminate the Guests vacation rental without refund and the Guest will immediately vacate the premises upon demand by The Property Managers and Owners and will forfeit all rental payments.

SAFETY: Guests acknowledge and agree that they are responsible for the safety of themselves, their guests, and their children with respect to pools, lakes, oceans, bays, jacuzzis, any water feature, patio, decks, yards, steps, floor surfaces, different gradients of land, and the premises as a whole. Guests acknowledge and agree to hold harmless from any injuries to them or their guests. It is understood that there is no lifeguard and that supervision is their responsibility.

KEYS: Access to the property is provided by the Property Manager via an electronic lock. 

LAWS: The Laws of the State of Florida shall apply to all terms under this Agreement. Any dispute under this agreement shall be venued in Pinellas County, Florida. It is expressly agreed and understood that this agreement shall not be recorded in the County Clerks office.

LIABILITY: Guests may be responsible and liable to The Property Managers and Owners for damages in excess of the security deposit for any damage or loss caused by Guests or its guest.

WRITTEN EXCEPTIONS: Any exceptions to the above-mentioned policies must be approved in writing in advance with Property Management.
